On August 7, 2013 (78 FR 48125), the Federal Motor Carrier Safety Administration (FMCSA) published a notice of proposed rulemaking (NPRM) to rescind the requirement in 49 CFR 396.11(b) that commercial motor vehicle (CMV) drivers operating in interstate commerce, except drivers of passenger-carrying CMVs, submit, and motor carriers retain, driver-vehicle inspection reports (DVIR) when the driver has neither found nor been made aware of any vehicle defects or deficiencies. Drivers will still be required to perform the inspections of equipment condition, but would eliminate the need to file a “no-defect DVIR” except for operations involving passenger-carrying CMVs. This NPRM will also harmonize the pre- and post-trip vehicle inspection lists by adding “wheels and rims” and “emergency equipment” to the pre-trip list in 49 CFR 392.7(a).
